These are the official Terms and Conditions of Use for SPARKBIZLAB located at 1206 Geneva - Switzerland, herein known and referenced as “Company,” “Our,” “We,” and “Us.”

NOTICE: This document DOES NOT constitutes a legally binding contract between SPARKBIZLAB and you regarding your purchase and use of AI-powered client acquisition systems, AI agents, AI automation templates, voice agents, and digital products (herein referred to as the “Product”). It is Your responsibility to read these Terms and Conditions of Use carefully prior to purchase, use, or access of any of Our products. By purchasing or accessing our products or services, you (herein referred to as “Client”) agree to the following terms as a condition of your participation in the Program.

GENERAL PROVISIONS

This website is owned and operated by SPARKBIZLAB.

You must be at least eighteen years of age to use Our website. Use of this website is at Your own risk. We host Our site on a reputable platform and take reasonable efforts to maintain and host the site. However, we make no explicit representations or warranties as to the safety of Your individual use of the website. The Terms and Conditions contained on this page are subject to change at any time.

PRODUCT LICENSE

You are not permitted to share any SPARKBIZLAB branded products that you have purchased with any other third party or attempt to copy or re-distribute the product, templates, frameworks, or AI system components in any way.

Each product license is for one use of the product, which is licensed directly to you for your singular personal or business use. You are not permitted to use the Company’s product on multiple businesses unless otherwise expressly authorized. Any violation of this clause shall result in immediate termination of your license and a fee equal to the cost of an approximate estimate of additional license(s) violated, in addition to attorney’s fees and other applicable fees, as liquidated damages.

NO REFUND POLICY

All digital products, AI workflows, automation templates, AI agents, downloads, and any other purchases made on this Site are non-refundable under any circumstances. Purchased products cannot be exchanged for other products.

CURRENCY

All payments will be processed in the local currency, or if not specified at checkout, in USD. Orders can be processed in EUR upon request.

TAXES

Sales taxes will be applied to your order as required by law in either Your or Our local area(s).

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, AI workflows, agent frameworks, functionality, software, website designs, audio, video, text, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

You may not copy, reproduce, republish, upload, publicly display, encode, translate, transmit, distribute, or otherwise exploit for commercial purposes any part of the Site, Content, or Marks, without Our prior written permission.

LICENSE TO USE SPARKBIZLAB PRODUCTS

You are not permitted to make any copies of the Company’s branded AI systems, provide access to any third parties, or sublicense the Company’s products or any of the rights herein. You may not reverse engineer or create derivative works based on any of the Company’s systems.

LICENSED THIRD-PARTY COMPONENTS

Some products may contain third-party licensed components (e.g., images, fonts, API integrations). These licenses are held by the Company and are not transferred to you. Any unauthorized use will be considered a breach of this Agreement and may incur liquidated damages of five thousand EUR (€5,000.00) per violation.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Site or offerings at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Site or services.

GOVERNING LAW

These Terms of Use and Your use of the Site are governed by and construed in accordance with the laws of the State of Geneva Switzerland.

DISPUTE RESOLUTION

To expedite resolution and control the cost of any dispute, the Parties agree to first attempt to negotiate informally for at least thirty (30) days before initiating arbitration.

USER DATA

We maintain certain data for performance and security. You are solely responsible for data you transmit. We are not liable for loss or corruption of such data.

ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

You consent to electronic communications and the use of electronic signatures. You waive rights requiring non-electronic formats.
